This study analyzes patent claim interpretation in three leading jurisdictions, the United States, Germany and Japan. Starting from well-established concepts such as literal infringement, the doctrine of equivalents and prosecution history estoppel, the author demonstrates significant differences in their application by reference to case examples. These differences are explained in historical and policy terms.
The need for a clear-cut, harmonized standard of claim interpretation throughout the world is urgent. As an aid towards that goal, the final chapter of this study contains a proposal for aligning still divergent legal principles.
Interpreting Patent Claims takes its place alongside two other studies of related aspects of patent rights in the IIC Studies Series: Benyamini's Patent Infringement in the European Community (Vol. 13, 1993) and Gilat's Experimental Use and Patents (Vol. 16, 1995). It contends that if the right is to be truly realized, these different contexts - which can be further classified as 'objective' and 'subjective' - must be understood, analysed and appropriately addressed before framing and implementing relevant action. The book further situates the human right to water discourse in a broader interdisciplinary perspective, expanding its scope beyond the narrower legal dimensions, linking it to the wider field of water resources management/governance. Two previous NATO Advanced Study Institutes (ASI) on berthing and mooring of ships have been held; the first in Lisboa, Portugal in 1965, and the second at Wallingford, England in 1973. Developments in ship sizes and building of new specialized terminals at very exposed locations have necessitated further advances in the combined mooring and fendering technology. Offshore activities and developments have in­ fluenced and improved knowledge about both ships and other floating structures which are berthed and/or moored under various environmental conditions. The scope of this ASI was to present recent advances in berth­ ing and mooring of ships and mooring of floating offshore structures, focusing on models and tools available with a view towards safety and reduction of frequencies and consequences of accidents.
